I General Provisions.
1. Service Provider.
1 The Service Provider, within the meaning of the Act of 18 July, 2002 on providing services by electronic means, is Fundacja Medical Tourism Foundation – a corporation organized and existing under the laws of Poland, with its registered office in Poland, Warsaw 02-672, at Domaniewska 39A, entered into the register of the National Court Register kept by the District Court for the Capital City of Warsaw, XIII Commercial Division of the National Court Register, KRS number 0000707618, with TAX ID 5213805121, and REGON (National Business Registry Number) 368915680, with its initial capital of 2 000 PLN.
1.2. Fundacja Medical Tourism Foundation is not a health care entity, within the meaning of the Act of 15 April, 2011 on medical activity and does not provide any type of medical and/or health-care services.
1.3. Fundacja Medical Tourism Foundation will send patient enquiries to Clinics and Partners.
1.4 Fundacja Medical Tourism Foundation is not a seller of any Partners’ services presented on the Medical Tourism Foundation Website, nor is it a Party to any contract in the case of conclusion of the contract between a Service User and a Partner. Medical Tourism Foundation is not responsible for an execution of the contract between the Service User and the Partner.
1.5 Medical Tourism Foundation is an external entity managing the provision of medical services within the meaning of article 27 §2 point 7 of the Act of 29 August, 1997 on the Protection of Personal Data, which means it processes sensitive personal data pertaining to a User’s health that is provided voluntarily and made public by the User.2. Definitions and Interpretation.
In these Terms and Conditions the following definitions shall have the following meaning:

“Medical Tourism Foundation Website”/ “Website”/ “Site” – specialized Internet portal available at the following URL addresses: medicaltourism.foundation owned by the Service Provider indicated in point 1 of these Terms and Conditions . The Website serves as a place to deliver to Users materials, information or current price lists in electronic form pertaining to medical, accommodation, travel and spa & wellness services provided within the territory of Poland. The Website enables, in particular:
a) obtaining information about Partners’ services;
b) obtaining information about the prices of services offered by Partners;
c) reading and adding opinions pertaining to Partners’ services;
d) making an appointment for a Partner’s services;
e) providing assistance in arranging travel and accommodation;
f) providing assistance in Treatments/Dental Arrangements made between Partners and Users;
g) providing assistance in transport between arranged points: Partners’ Plastic Surgery/Dental Clinic, the airport and the place of User’s stay in Poland.
h) providing customer service in English throughout the duration of the User’s stay in Poland.
“Comment” – a User’s statement published by the User regarding materials posted on the Site. Comments can only be published by Users who have Registered, but at the User’s request a Comment can be published without providing the User’s name and surname; the only identifier of the User will be a name or screen name indicated by the User. A Comment is published after verification by the Site Operator, who ensures it does not have offensive, vulgar, obscene, pornographic, racist or advertising contents.
“Consumer” – a User who benefits from the Services available on the Site in a way that is not related with business or professional activities.
“Contact form” – an electronic document enabling communication between the Service Provider and a User as well as a User and a Partner, the filling of which is necessary for the implementation of Services.
“Contract” – a contract for the provision of services described in the Terms of service, entered into for an indefinite period between the User and the Service Provider to the extent and under the conditions specified in the Terms and Conditions , including the following services:
a) Information services – a free service provided electronically, offered through the Site; it consists of providing websites that allow Partners to present their services and Users to familiarize themselves with the Partners’ offers as well as information on the available medical, accommodation, tourism, spa & wellness services in Poland. Information services do not require any input by the User, who can use it anonymously, regardless of age.
b) “Make an appointment” service – a free service provided electronically or via telephone, involving making appointment for medical, cosmetic, travel or/and accommodation services; “Health services” – activity aimed at prevention, maintaining, saving, restoring or improving health and other medical activity resulting from the treatment process or separate legislation for providing them.
“Infoline” – dedicated phone lines enabling Registration, contact between a User and a Service Provider employee as well as a User and a Partner in order to take advantage of a Partner’s services. Conversations conducted via the Infoline are recorded and stored by the Service Provider in compliance with the law.
“Opinion” – a User’s assessment of a Partner’s service published on the Site. At the User’s request an Opinion can be published without providing the User’s name and surname; the only identifier of the User will be a name or screen name indicated by the User. An Opinion is published after verification by the Site Operator, who verifies if the User used the Partner’s services and ensures the Opinion does not have contents of an offensive, vulgar, obscene, pornographic, racist or advertising nature.
“Online chat” – online discussion between a User and a Service Provider employee (consultant) involving sending test messages on the Site. The discussion is meant to help in the realization of Services and is used to Register Users.
“Partner” – legal entities undertaking health care activities within the meaning of the Act of 15 April, 2011 on medical activity or entities offering services such as accommodation, SPA & Wellness, as well as other services presented on the Site.
“Partner’s Service” – services offered by Partners, such as:
a) Medical service – any medical service performed in the field of medicine by a health care entity within the meaning of the Act on medical activity (Journal of Laws from 2011 No. 112, item 654), in particular including aesthetic medicine;
b) Accommodation and travel service;
c) Cosmetic services, biological regeneration services, aesthetic medicine, anti-aging and other beauty and health-related services.
“Service provided electronically” – a service provided without the simultaneous presence of the parties (at a distance), through the transmission of data on an individual request of a recipient, transmitted and received using devices for electronic processing, including digital compression and data storage, which is entirely sent, received or transmitted with the help of a telecommunications network within the meaning of the Act of 16 July, 2004 Telecommunications Law.
“Site Operator” – the Service Provider, i.e. Medical Tourism Foundation with its registered office in Poland, Warsaw 02-672, at Domaniewska 39A.
“Site User” – anyone can use the Site as an information service; anyone who has a device with a web browser and access to the Internet and who goes to one of the following domains: medicaltourism.foundation. The other Services can only be accessed by a User who is an adult having full legal capacity, capable of giving consent for health care services and incurred liabilities.
“Registration” – the process of creating an Account for a User, necessary for the realization of Services, consisting of sending the User’s personal data necessary for the realization of Services, done by filling out the Contact form available on the Site and providing data to the Infoline consultant via telephone or online (Online chat).
“Terms of service” – these terms of service, whose acceptance is required for the realization of services.
3. Medical Tourism Foundation Website Content.
3.1 The information contained on the Site is not a substitute for professional medical advice, diagnosis or treatment. All publications included on the Site are for information purposes only. A User of the Site under any circumstances cannot disregard medical advice or delay seeking medical advice because of information available on the Site or obtained in connection with the Services provided by the Service Provider.
3.2 The Service Provider does not recommend nor endorse any specific examinations, tests, physicians, medical procedures, opinions or other information contained on the Site.
3.3 The Service Provider is not responsible for a User’s decision to make use of specific Partner’s services (e.g. a doctor, a medical centre, a spa & wellness centre)
3.4 The Service Provider shall make every effort to ensure that the information contained on the Site is current. In case of any doubt about the information contained on the Site, a User should contact a Partner in whose services they are interested directly. A User can seek further information from Infoline consultants, use our contact form or online chat.
II Conditions For Using the Website.
4. Registration Process and Conditions for Using the Website.
4.1 The conditions for using the Site are:
a) having access to a computer or other device equipped with an Internet connection and a browser that can display hypertext documents linked to the Internet and that supports JavaScript programming language, and also accepts cookies;
b) acceptance of these Terms of service, Privacy Policy and giving consent for personal data processing to the extent necessary to provide Services.
4.2 Use of the Site is free.
4.3 During the filling out the Contact form, the User must fill in the fields marked with an asterisk (*). Refusal to provide the data may result in the denial of providing Services by the Service Provider and Partners due to the type of Services concerned. Refusal to fill in the fields marked with an asterisk (*) is equivalent to lack of contact.
4.4 Consent for personal data processing referred to in paragraph 4 is done by ticking the box on the Contact form: “I give my consent for processing my personal data”.
4.5 In the case of Registration by telephone through the Infoline, consent for personal data processing is given orally, by accepting the consultant’s statement, which reads “I hereby authorize you to process my personal data, including sensitive data on health status and communicating this information to the Service Provider selected by me, necessary for service provision by Medical Tourism Foundation with its registered office in Poland, Warsaw 02-672, at Domaniewska 39A, on the terms specified in the regulations for providing e-services”.
4.6 Any content published on the Site, including images, videos, databases, are owned by the Service Provider and may not be copied, distributed or modified by the User.
4.7 The logo, graphic design and content of the Site are protected by copyright and industrial property law.
III. Final Provisions
5. Complaints and Settling Disputes.
5.1 The User has the right to submit a complaint in writing, by fax, telephone, electronically (e-mail) or in person (orally or in writing) at the headquarters of the Site Operator, i.e. at the address: Poland, Warsaw 02-672, Domaniewska 39A, e-mail: contact@medicaltourism.foundation. The content of the complaint must indicate a name, surname, mailing address or e-mail, reasons for the complaint, and the expected Service Provider’s reaction (what the User wants). If the data or information provided in the complaint need to be supplemented, the Site Operator before dealing with the complaints shall ask the User to supplement them. Complaints are dealt with within 14 days from the date of receipt by the Site Operator of a complete notification of the complaint by sending in a manner chosen by the User (by letter or e-mail) information about how the complaint should be handled.
5.2 Complaints about a Partner’s Service will not be considered by the Service Provider and will be returned to the User. Any disputes related to the Services of the Service Provider shall be considered by the appropriate court of general jurisdiction over the location of the Service Provider’s headquarters.
5.3 The applicable law is Polish law. The User can also use out of court means of redress through mediation. Detailed rules for access to those procedures and lists of mediators are available on the websites of District Courts.
6. Personal Data Processing.
6.1 During the Registration process or by filling out the Contact form or during conversation with Infoline consultant, the User of the Site gives consent for personal data processing by the Site Operator: Medical Tourism Foundation – a corporation organized and existing under the laws of Poland, with its registered office in Poland, Warsaw 02-672, at Domaniewska 39A, entered into the register of the National Court Register kept by the District Court for the Capital City of Warsaw, XIII Commercial Division of the National Court Register, KRS number 0000707618, with TAX ID 5213805121, and REGON (National Business Registry Number) 368915680, with its initial capital of 2 000 PLN.
6.2 The realization of the “Get a free quote” Services requires User consent to send User personal data to a Partner. The User gives consent by checking the appropriate box and filling out the Contact form or makes an oral declaration to an Infoline consultant.
6.3 In order to be able to use the full functionality of the Site and to present the Services of Partners that are trustworthy and represent the highest quality, the User can optionally agree to send personal data provided to the Service Provider, including sensitive Partner data, and obtaining data from Partners whose services the User used about feedback on the scope and value of the Services.
6.4 The User can give consent for personal data processing also for marketing purposes. No consent for data processing for marketing purposes does not result in an inability to Use the Site’s Services.
6.5 Providing personal data by the User is necessary for the proper realization of the Services by the Provider and Partners.
6.6 The Service Provider may process the following User personal data necessary to establish and shape the content, make changes or terminate the legal relationship between them:
a) User’s first name and surname;
b)PESEL (Polish citizen personal identification) number or – if this number has not been assigned – passport number,
c) identity card number or the number of another document confirming identity,
d) registered address,
e) mailing address,
f) data used to verify the User’s electronic signature,
g) data on the User’s health status, if they are provided by the User
These Medical Tourism Foundation Terms and Conditions shall enter into force on January 4, 2018
